Before purchasing our products and services ICE-scan Limited (the ‘company’) ask that you read our following terms and conditions very carefully.
All references to the ‘company’, ‘us’, or ‘we’ will refer to ICE-scan Limited. All references to ‘the customer’ or ‘you’ or ‘your’ or ‘user‘ shall mean the person, persons or organisation purchasing or agreeing to purchase our products and services from the company or for whom the products have been purchased on their behalf.
All references to ‘products’ or ‘goods’ or ‘order’ will refer to the uniquely numbered ICE-scan QR tags provided by the company as part of your ICE-scan Limited purchase via the ICE-scan APP (our ‘APP’).
All references to our ‘services’ will refer to the personalised account that you agree to create and maintain with the company when you purchase our products and services.
Without notice our terms and conditions are subject to change and these changes will be posted as and when they occur on our website https://ice-scan.com/terms-conditions/ and our APP.
By purchasing the products and services of the company you agree to be bound by its terms and conditions.
The terms and conditions that are posted on our website and our APP will apply at the time of your purchase of our products and services.
If for any reason you are unable to agree to our terms and conditions, we respectfully ask that you do not purchase our products and services .
We ask that you also read the Privacy Policy https://ice-scan.com/privacy-policy/ of the company as this outlines how the personal data that you input into your account via our APP is recorded and administered by the company.
The following terms and conditions of the company apply to the use of our services, our products, our website, our APP and to your ICE-scan.com purchase. By accessing our website or by registering for an ICE-scan.com account by placing an order for our products and services via our APP you agree to contract with us and be bound by the terms and conditions detailed below.
Governing Law
These Terms and Conditions are governed and construed under the laws of England and Wales. This means that a Contract for the purchase of our products and services via our APP and any dispute or claim arising out of or in connection with that purchase will be governed by the laws of England and Wales. You and the company agree that the courts of England and Wales will have non-exclusive jurisdiction.
Pricing and payment
The price of our services and products are those quoted on our APP at the time that you submit your order and is inclusive of VAT at the prevailing rate that is chargeable in the United Kingdom. All prices are quoted in pounds sterling (£). Delivery of our products are made free of charge to postal addresses within the United Kingdom and the Republic of Ireland only.
Payments by debit or credit card will be made in pounds sterling (£) and any differences in exchange to the currency that specifically relates to your particular debit or credit card will be calculated by the provider of that card.
All credit and or debit card transactions connected with the purchase of our products and services are ultimately authorised by the card issuer. The company will accept payments from the following organisations – Delta, Electron, Maestro, Mastercard, Maestro, Solo, Visa.
Payment for our products and services
Our products and services are provided on once only basis at the price quoted on our APP
Payments are placed through our APP via secure servers located in the United Kingdom.
We will acknowledge your purchase of our services and products within our APP and additionally send you an email acknowledgement to confirm that your order has been received – this acknowledgement however is not a notification or confirmation that we have accepted your order.
If your card issuer refuses payment authorisation the company will not be liable for any delay and/or non-delivery of your products. Your products will not be despatched until payment authorisation of a valid debit or credit card has been received by the card issuer.
All credit/debit card transactions are subject to the usual and accepted validation checks and are ultimately authorised by the card issuer. ICE-scan.com accept payments from the following organisations; Delta, Electron, Maestro, Mastercard, Maestro, Solo and Visa.
Delivery of your products
Subject to availability we will endeavour to deliver your products within seven (7) working days of your order being placed via our APP but up to a maximum of twenty-eight (28) days. If you have not received your products within this timescale you can use the contact form at https://ice-scan.com/contact/ stating the name and address and email address details used in placing your order
The goods ordered will be delivered to the postal address provided by you when an order is placed via our APP. We are unable to deliver to a ‘PO Box’ address.
If we are unable to supply your goods within twenty-eight days, we will inform you immediately via the email address entered in your purchase and advise you of the expected delivery date. Deliveries will be made by the Royal Mail or by an authorised delivery provider within the United Kingdom.
Should your goods reach you in a damaged state or otherwise not in accordance with your order then you must notify us via the contact form at https://ice-scan.com/contact/ within three (3) working days of receipt stating the name and address and email address details used in placing your order
Cancellation of your contract
With an acceptable reason and within seven (7) working days, you have the right to cancel your contract with the company for the purchase of your products and our service under the UK’s Consumer Protection (Distance Selling) Regulations 2000 https://www.legislation.gov.uk/uksi/2000/2334/contents/made.
If you fail to take delivery of your order due to your cancellation of our contract you will, under the Distance Selling Regulations, be entitled to a refund for the full value of your order within thirty (30) days of your cancellation.
In all circumstances, cancellation of your contract by you will immediately invoke deletion of your account from our records. Any accounts directly associated with your order will also be immediately deleted.
In exercising your rights to cancel your order you are required to return the goods to us at no cost to the company however, if you fail to return the goods to us we reserve the right to deduct any costs incurred by the company from the refund sum due to you.
You acknowledge that you return goods to us at your own risk so we recommend that you send them, at your cost, by recorded delivery to ICE-scan Limited, 19, Goldington Road, Bedford, Bedfordshire MK40 3JY.
Guarantee
Your set of five (5) ICE-scan QR Tags are guaranteed for a period of two (2) years (24 months) from the date of the original purchase unless otherwise stated. This guarantee does not cover faults caused by accidents, misuse or neglect.
Replacement ICE-scan QR Tags can be requested via our website contact form https://ice-scan.com/contact/ at the price quoted at the time on our APP by stating the name and address and email address details used in placing your order.
Replacement QR tags will have unique account details and will require you to activate your new account and input your personal details as before. Your existing account will be deleted within 14 days after despatch and those particular account details will no longer accessible.
The ICE-scan APP is formatted in order to assist any first on scene responder to an accident or emergency to access the personal, medical and contacts details of the users ICE-scan tag, be they medically trained personnel or an untrained member of the general public,
The user accepts that ICE-scan Limited cannot be held responsible for the failure of their QR tag in the event of an accident or emergency that may result in harm to its wearer, including the wearers death.
ICE-scan Limited cannot be held responsible for the data that is held on its servers. The user acknowledges that it is their sole responsibility to ensure that their personal, medical and contacts information is both relevant and current.
ICE-scan Limited cannot be held responsible for any failure of the communications network in the locality of the accident or emergency or for any mobile device incapable, for whatever reasons, which results in the APP and/or website not being accessible
Ownership of ICE-scan QR tags
ICE-scan QR tags supplied to the customer remain the property of the company until full and final payment has been received by the company.
Intellectual Property
The ICE-scan.com APP, our website and our QR Tags contain registered designs, colours and graphics which, together with our brand name, remains the protected intellectual property rights of the company. By using the ICE-scan.com APP and our website you acknowledge our intellectual property rights and agree to adhere to these terms of use.
Complaints
Should you wish to make a complaint to the company, we ask that you do so via the contact form on our website https://ice-scan.com/contact/ stating your name and email address together with the name, postal address and email address details used in placing the order to which your products are associated.
We aim to deal with your complaint within two (2) working days but in the event that this is not possible we will advise you by email of our estimated delay. At all times we will endeavour to keep you fully informed of the status of your complaint
Data Protection
You acknowledge that in an accident or emergency the information contained within your personal profile may become visible and available to persons either known and/or unknown by you. You also accept that information that you add to your personal profile that is not your own are however your responsibility and that ICE-scan Limited cannot be held responsible for any omissions or errors incurred.
You also acknowledge that you have the right to publish this information on behalf of other individuals, specifically a minor who are under your care or as a parent or as a guardian of that minor.
ICE-scan Limited operates as the data controller and maintains a strict adherence to and complies with data security and personal data privacy as detailed in the UK Data Protection Act 2018 https://www.gov.uk/government/collections/data-protection-act-2018 and General Data Protection Regulation (EU) 2016/679 https://gdpr-info.eu/
By agreeing to these terms and conditions your statutory rights will not be affected.
